CONSOLIDATION
CITY OF WATERLOO
BY-LAW #89-137
BY-LAW ESTABLISHING AND LAYING OUT CERTAIN LANDS IN THE
CORPORATION OF THE CITY OF WATERLOO WHERE VEHICLES MAY BE
PARKED AND FOR REGULATING, SUPERVISING AND GOVERNING THE
PARKING OF VEHICLES THEREIN OR THEREON.
THE MUNICIPAL COUNCIL OF THE CORPORATION OF THE CITY OF
WATERLOO ENACTS AS FOLLOWS:
DEFINITIONS
1. For the purpose of this by-law:
(a) "Park" means the standing of a vehicle, whether the
vehicle is occupied or not.
(b) "Police Officer" means a member of the Police Force
or a person authorized by the Chief of Police of the
Regional Municipality of Waterloo to enforce the
provisions of this by-law.
(c) "By-Law Enforcement Officer" means a person
authorized by the City of Waterloo to enforce the
provisions of this by-law.
(d) "Vehicle" includes a motor vehicle, trailer,
traction engine, farm tractor, road-building machine
and any vehicle drawn, propelled or driven by any
kind of power, including muscular power, but not
including the car of electric or steam railways
running only upon rails.
(e) "Parking Permit" means a clearly displayed decal or
a specially designed card as authorized by the City
Treasurer.
(f) "Person" shall include the owner or operator of a
vehicle.
(g) "Parking Meter" means a device that shall indicate
thereon the length of time during which a vehicle
may be parked or shall produce a receipt indicating
the amount of parking time purchased, and which
shall have as a part thereof a receptacle for
receiving and storing coins, a slot or place in
which such coins may be deposited, a timing
mechanism to measure the passage of the interval of
time during which the parking is permissible and
which shall also display a signal when said interval
of time shall have elapsed or which shall produce a
receipt indicating the amount of parking time
purchased.
(h) "Parking Lot" means such property as may be
designated for parking purposes by Council,
including but not limited to, surface lots and
parking structures.

ESTABLISHMENT OF PARKING LOTS
2. (a) The lands outlined in black on Drawing No. 22-26
attached hereto and forming a part hereof are hereby
established and laid out as land where vehicles may
be parked and for the purpose of this by-law said
lands shall be called the Dupont Parking Lot and the
Library Parking Lot.
(b) The lands outlined in black on Drawing No. 22-31
attached hereto and forming a part hereof are hereby
established and laid out as lands where vehicles may
be parked and for the purposes of this by-law, said
lands shall be called the Gallery Parking Lot and
the Museum Parking Lot.
(c) The land outlined in black on Drawing No. 22-32
attached hereto and forming
a
part
hereof is hereby established and laid out as land
where vehicles may be parked and for the purposes of
this by-law, said lands shall be called the Caroline
Parking Lot, the Peppler Parking Lot and the
Alexandra Parking Lot.
(d) Repealed by By-law No. 01-60.
(e) The land outlined in black on Drawing No. 22-35
attached hereto and forming a part hereof is hereby
established and laid out as land where vehicles may
be parked and for the purposes of this by-law, said
lands shall be called the William Parking Lot.
(f) The lands outlined in black on Drawing No. 22-36
attached hereto and forming a part hereof are hereby
established and laid out as lands where vehicles may
be parked and for the purpose of this by-law, said
lands shall be called the Regina Parking Lot.
(g) The land outlined in black on Drawing No. 22-36
attached hereto and forming a part hereof is hereby
established and laid out as land where vehicles may
be parked and for the purpose of this by-law, said
lands shall be called the City Centre Parking Lot.
(h) The land outlined in black on Drawing No. 22-48
attached hereto and forming a part hereof is hereby
established and laid out as land where vehicles may
be parked and for the purpose of this by-law, said
lands shall be called the Willow Parking Lot.
(i) The land outlined in black on Drawing No. 22-35
attached hereto and forming a part hereof is hereby
established and laid out as land where vehicles may
be parked and for the purpose of this by-law, said
lands shall be called the Herbert Parking Lot.
(j) The land outlined in black on Drawing No. 22-33
attached hereto and forming a part hereof is hereby
established and laid out as land where vehicles may
be parked and for the purpose of this by-law, said
lands shall be called the Uptown Parkade.
(k) Repealed by By-Law No. 94-9.

(l) The land outlined in black on Drawing No. 22-60
attached hereto and forming a part hereof is hereby

established and laid out as lands where vehicles may
be parked and for the purposes of this by-law, said
lands shall be called the Station Parking Lot.
(m) The land outlined in red on Drawing No. 22-61
attached hereto and forming a part hereof is hereby
established and laid out as land where vehicles may
be parked and for the purpose of this by-law said
lands shall be called the Erb Street Parking Lot.
(n) The lands outlined in black on Drawing No. 22-58
attached hereto and forming a part hereof is hereby
established and laid out as land where vehicles may
be parked and for the purpose of this by-law, said
lands shall be called the Bauer Lot.
PARKING REGULATIONS
3. (a) When properly worded signs have been erected and
are on display, no person shall park a vehicle
between the hours of 9:00 a.m. and 5:00 p.m. on any
day except a Saturday, Sunday, Statutory Holiday,
for a longer period of time than two (2) hours on
the Gallery Parking Lot in the area outlined in blue
on Drawing No. 22-31.
(b) Repealed by By-Law No. 94-9.
(c) Repealed by By-Law No. 94-9.
(d) Repealed by By-Law No. 93-73.
(e) When properly worded signs have been erected and are
on display in the City Centre Parking Lot, no person
shall park a vehicle between the hours of 8:00 a.m.
and 5:00 p.m. on any day except a Saturday, Sunday
or a Statutory Holiday for a longer period of time
than two (2) hours in the area outlined in blue on
Drawing No. 22-36.
(f) When properly worded signs have been erected and are
on display in the Station Parking Lot, no person
shall park a vehicle between the hours of 8:00 a.m.
and 5:00 p.m. on any day except a Saturday, Sunday
or Statutory Holiday for a longer period of time
than two (2) hours in the area outlined in blue on
Drawing No. 22-60.
(g) Repealed by By-Law No. 94-9.
(h) When properly worded signs have been erected and are
on display in the Erb Street Parking Lot, no person
shall park a vehicle between the hours of 8:00 a.m.
to 5:00 p.m. on any day except a Saturday, Sunday or
Statutory Holiday for a longer period of time than
two (2) hours in the area outlined in red on Drawing
No. 22-61.

4. (a) No one shall park a vehicle in the area of the
Gallery Parking Lot which is outlined in red on
Drawing No. 22-31 between the hours of 9:00 a.m.

and 5:00 p.m. on any day except a Saturday, Sunday
or Statutory Holiday unless the vehicle being parked
has an unexpired parking permit identified by the
letters "AL" affixed to its windshield or clearly
displayed in the windshield area of the vehicle.
(b) Repealed by By-Law No. 94-9.
(c) No one shall park a vehicle in the area of the
Dupont Parking Lot which is outlined in red on
Drawing No. 22-26 between the hours of 9:00 a.m. and
5:00 p.m. on any day except a Saturday, Sunday or
Statutory Holiday unless the vehicle being parked
has an unexpired parking permit identified by the
Letter "D" affixed to its windshield or clearly
displayed in the windshield area of the vehicle.
(d) No one shall park a vehicle in the area of the
Caroline Parking Lot which is outlined in red on
Drawing No. 22-32 and 22-68 between the hours of
8:00 a.m. and 5:00 p.m. on any day except a Sunday
or Statutory Holiday unless the vehicle being parked
has an unexpired parking permit identified by the
letter “ C”
affixed to its windshield or clearly
displayed in the windshield area of the vehicle.
(e) Repealed by By-law No. 97-166.
(f) No one shall park a vehicle in the area of the
Alexandra Parking Lot which is outlined in red on
Drawing No. 22-32 between the hours of 9:00 a.m. and
5:00 p.m. on any day except a Saturday, Sunday or
Statutory Holiday unless the vehicle being parked
has an unexpired parking permit identified by the
letter "A" affixed to its windshield or clearly
displayed in the windshield area of the vehicle.
No one shall park a vehicle in the area of the
Alexandra Parking Lot which is outlined in blue on
Drawing NO. 22-32 between the hours of 2:30 a.m. and
6:00 a.m. from March 1
st
to November 20
th
unless the
vehicle being parked has an unexpired overnight
parking permit identified by “ A – OVERNIGHT”
affixed to its windshield or clearly displayed in
the windshield area of the vehicle.
(g) Repealed by By-law No. 01-60.
(h) No one shall park a vehicle in the area of the
William Parking Lot between the hours of 8:00 a.m.
and 5:00 p.m. on any day except a Saturday, Sunday
or Statutory Holiday unless the vehicle being parked
has an unexpired parking permit identified by the
letter "W" affixed to its windshield or clearly
displayed in the windshield area of the vehicle.

(i) No one shall park a vehicle in the area of the
Station Parking Lot which is outlined in red on
Drawing No. 22-60 between the hours of 8:00 a.m. and
5:00 p.m. on any day except a Saturday, Sunday or a

Statutory Holiday unless the vehicle being parked
has an unexpired parking permit identified by the
letter "S" affixed to its windshield or clearly
displayed in the windshield area of the vehicle.
(j) No person shall park a vehicle in the area of the
City Centre Parking Lot which is outlined in red on
Drawing No. 22-36 between the hours of 8:00 a.m. and
5:00 p.m. on any day except a Saturday, Sunday or
Statutory Holiday unless the vehicle being parked
has an unexpired parking permit identified by the
letter "CC" affixed to its windshield or clearly
displayed in the windshield area of the vehicle.
(k) No person shall park a vehicle in the area of the
Willow Parking Lot unless the vehicle being parked
has an unexpired parking permit identified by the
letters "WL" affixed to its windshield or clearly
displayed in the windshield area of the vehicle.
(l) No person shall park a vehicle in the area of the
Herbert Parking Lot between the hours of 8:00 a.m.
and 5:00 p.m. on any day except a Saturday, Sunday
or Statutory Holiday unless the vehicle being parked
has an unexpired parking permit identified by the
letter "H" affixed to its windshield or clearly
displayed in the windshield area of the vehicle.
(m) Repealed by By-law No. 97-166.
(o) No one shall park a vehicle in the area of the
Regina Parking Lot which is outlined in red on
Drawing No. 22-36 between the hours of 8:00 a.m.
and 5:00 p.m. on any day except a Saturday, Sunday
or a Statutory Holiday unless the vehicle being
parked has an unexpired parking permit identified by
the letter "R" affixed to its windshield or clearly
displayed in the windshield area of the vehicle.
(p) No person shall park a vehicle in any of the sixteen
(16) angle parking spaces on Caroline Street
outlined in blue on Drawing No. 22-63 between the
hours of 2:30 a.m. and 6:00 a.m. from March 1
st
to
November 20
th
unless the vehicle being parked has an
unexpired overnight parking permit identified by
“ CAROLINE ST. – OVERNIGHT”
affixed to its
windshield or clearly displayed in the windshield
area of the vehicle.
(q) No person shall park a vehicle in the area of the
Bauer Parking Lot which is outlined in red on
Drawing No. 22-58 between the hours of 8:00 a.m. and
5:00 p.m. on any day except a Saturday, Sunday or a
Statutory Holiday unless the vehicle being parked
has an unexpired parking permit identified by the
letter “ B”
affixed to its windshield or clearly
displayed in the windshield area of the vehicle.

(r) No person shall park a vehicle in the area of the
Waterloo Memorial Recreation Complex southwest lot
which is outlined in red on Drawing No. 22-59
between the hours of 8:00 am and 5:00 p.m. on any
day except a Saturday, Sunday or a Statutory Holiday
unless the vehicle being parked has an unexpired

parking permit identified by the letter “ S/W”
affixed to its windshield or clearly displayed in
the windshield area of the vehicle.
5. (a) Repealed by By-Law No. 94-9.
(b) Repealed by By-law No. 01-60.
(c) No one shall park a vehicle in the Museum
Parking Lot which is outlined in brown on Drawing
No. 22-31 and which shall be controlled by a parking
meter at the rate of $1.00 per hour between the
hours of 8:00 a.m. and 6:00 p.m. on any day except
a Saturday, Sunday or Statutory Holiday without
displaying a recept indicating the amount of parking
time purchased in the windshield area of the
vehicle.
(d) Repealed by By-Law No. 89-8.
(e) No one shall park a vehicle in the Library
Parking Lot which is outlined in brown on Drawing
No. 22-26 and which shall be controlled by a parking
meter at the rate of $1.00 per hour between the
hours of 9:00 a.m. and 9:00 p.m. on any day except
a Sunday or a Statutory Holiday without displaying a
receipt indicating the amount of parking time
purchased in the windshield area of the vehicle.
(f)(i) When appropriate signs have been erected, no
one shall park a vehicle in the Dupont Lot which is
outlined in bold on Drawing No. 22-26 and which
shall be controlled by a pay and display machine at
the rate of $1.00 per hour between the hours of 9:00
am and 5:00 pm Monday through Friday except a
Statutory Holiday, without displaying a receipt
indicating the amount of parking time purchased in
the windshield area of the vehicle.
(ii)
When
appropriate
signs
have
been
erected, no one shall park a vehicle in the Dupont
Lot which is outlined in green on Drawing No. 22-26
and which shall be controlled by a pay and display
machine at a rate of $1.00 per hour between the
hours of 5:00 pm and 9:00 pm Monday through Friday
except a Statutory Holiday and on Saturday between
9:00 am and 9:00 pm without displaying a receipt
indicating the amount of parking time purchased in
the windshield area of the vehicle.

7.
When properly worded signs have been erected, no
person shall park any vehicle in the Dupont Parking
Lot, Caroline Parking Lot, Gallery Parking Lot,
Regina Parking Lot, William Parking Lot, Station
Parking Lot, City Centre Parking Lot, Herbert
Parking Lot, Bauer Parking Lot, Museum Parking Lot
and Erb Street Parking Lot between the hours of 2:30

a.m. and 6:00 a.m. for everyday during the week,
including Statutory Holidays.
8.
Where properly worded signs are erected and are on
display or when adequate pavement parking markings
are evident no person shall park except in the areas
designated by such signs or pavement markings.
9.
Where properly worded signs have been erected and
are on display, no person shall park any vehicle in
the two designated parking spaces in the Dupont
Parking Lot which are outlined in green on drawing
No. 22-26, unless the vehicle being parked is owned
and identified as being owned by the People’s Car
Co-op who have total and exclusive use of these
spaces until June 2002 and who may park their
vehicles on these spaces at any time.
10. The City Treasurer shall arrange for a parking permit
to be sold for the above-mentioned lots as follows:
(a) Dupont Parking Lot Permits identified by the
letter "D"
(b) Caroline Parking Lot
Permits
identified by the letter "C"
(c) Herbert Parking LotPermits identified by the
letter "H"
(d) Gallery Parking LotPermits identified by the
letters "AL"
(e) Alexandra Parking Lot

11. (I) The charges to be collected by the City Treasurer
for the issuing of parking permits are as follows:

(a) Dupont Parking Lot, William Parking Lot, Herbert
Parking Lot, Regina Parking Lot, Station Parking
Lot, and Gallery Parking Lot:
$600.00 per year based on $45.00 per month, includes
PST & GST
Bulk permit sales (10 or more) will be offered at
$40.00/month
(b) Caroline Parking Lot, Alexandra Parking Lot,
Seagram Parking Lot, Willow Street Parking Lot,
Bauer Parking Lot and Waterloo Memorial Parking Lot
(southwest lot):.
Annual permits issued as per lease agreements by
various companies/property owners.
12. (II)
ATTENDED LOTS AND/OR GARAGES
No person shall park a vehicle in the following
parking lot(s) without obtaining a ticket, producing
the ticket for the parking attendant and paying the
appropriate fee as indicated by the parking
attendant. When no parking attendant is on duty,
the fee specified below shall be paid in the manner
indicated when exiting the parking lot.

13.
The aforesaid parking permits are to be sold only to
persons
working in the City of Waterloo Uptown Area.
14.
The aforesaid parking permits shall be issued for
twelve month
periods or for lesser periods if necessary but, in
any event,
the parking permits must cover the period to expiry
date.
15.
The expiry date for the aforesaid parking permits
shall be
December 31st of each year.
16.
The City Treasurer shall provide each purchaser of a
parking
permit with a set of rules outlining expiry date and
all
other pertinent information.
17.
The City Treasurer shall maintain a Register which
will contain
the following information:
(a) Name and address of permit holder;
(b) Name of employer;
(c) Date of application;
(d) Parking permit number;
(e) Expiry date;
(f) Amount paid.
18.
No one shall park a vehicle having a weight greater
than three tons in gross vehicle weight shall be
parked on any of the parking lots designated in this
by-law.
VOLUNTARY PAYMENT OF PENALTIES
19. Where a vehicle is found in contravention of the parking
provisions of this
by-law, the By-Law Enforcement
Officer or Police Officer so finding the
vehicle
shall attach to the vehicle a Parking Infraction Notice in
the form of
a serially numbered notice stating:
(a) the permit number and a concise description of
the vehicle;
(b) that the vehicle is unlawfully parked;
(c) the date, time, place and nature of the alleged
offence;

(d) that the owner or operator thereof may report to
the Revenue
Division of the City of Waterloo within fifteen
(15) days
exclusive of Saturday, Sunday and Holidays,
after the day
when the Parking Infraction Notice is attached
or forward said
payment by mail within fifteen (15) days to make
a voluntary
payment of the penalty;
(e) that in the event of failure to so report and
make such payment the provisions of The
Provincial Offences Act will apply.
20. The Parking Infraction Notice shall be prepared in
triplicate and the
By-Law Enforcement Officer or Police Officer shall
attach one copy
to the vehicle and deliver the other copies to the City
Treasurer
or other designated Official on duty in the Revenue
Division of the
City of Waterloo.
21. The voluntary payment referred to Section 17 shall be as
follows:
(a) Parking over By-Law limit

(d) Parking between 2:30 a.m. and 6:00 a.m.

Said voluntary payment shall be accepted as a payment of
a penalty in full
satisfaction in respect to the
alleged offence and receipt therefore shall be
given to
the person making the payment.
22. If a voluntary payment is not paid in accordance with
the procedure
provided in paragraph 17 the provisions of The
Provincial Offences Act
shall apply.
23. Every person who contravenes any provision of this
by-law;
i) is guilty of an offence;
ii)
upon conviction of an offence is liable
to a fine or penalty of not more than Five
Thousand ($5,000.00) Dollars as prescribed by
the Provincial Offences Act.
24. In addition to any other provision of this by-law, where
a motor vehicle is
parked
or
left
in
contravention of this by-law, a Police Officer or By-Law
Enforcement Officer may cause such motor vehicle to be
moved or taken to
and be placed or stored in a
suitable place and all costs and charges for

removing, care and storage thereof, if any, are a lien
upon the said motor
vehicle which may be enforced in a manner provided in
the Repair
and Storage Liens Act, 1989.

25. That By-Law 80-201 and any other by-laws inconsistent
with the provisions
of this by-law are hereby
repealed.
26. This by-law shall come into effect on the date of the
final passing thereof
