CITY OF WATERLOO
BY-LAW NO. 91-101
CONSOLIDATION
BY-LAW TO PROHIBIT THE RUNNING AT LARGE OF DOGS IN THE CITY OF
WATERLOO, FOR IMPOSING A LICENSE FEE ON THE OWNERS OF DOGS, FOR
REGULATING THE DISPOSAL OF DOGS FOUND RUNNING AT LARGE IN THE SAID
CITY AND FOR OTHER MATTERS RELATING TO DOGS.
WHEREAS the Municipal Council of The Corporation of the City of Waterloo deems it
desirable to prohibit the running of dogs at large in the City and otherwise providing for the
seizing, impounding and killing of dogs running at large and for selling dogs so impounded as
hereinafter set forth and for licensing and regulating the owners of dogs in the said City.
THEREFOR THE MUNICIPAL COUNCIL OF THE CORPORATION OF THE CITY
OF WATERLOO ENACTS AS FOLLOWS:
1.
(a) In this by-law the word "dog" means for licensing purposes only, any dog,
male or female over the age of twelve (12) weeks.
(b) In this by-law the word "building" means any structure used or intended to be
used for the shelter, accommodation or enclosure of persons or chattels other
than a boundary wall or fence.
c)
In this by-law an "owner" of a dog includes a person who possesses or
harbours a dog, and, where the owner is a minor the person responsible for the
custody of the minor and "owns" and “owned" have a corresponding meaning.
(d) In this by-law the phrase "not under the control of any person" means not held
on a leash by the owner or any other person or not tied up.
(e) For the purpose of this by-law, a dog shall be deemed to be running at large:
(i) when found in any place other than the premises of the owner of the dog
and not under the control of any person and not under leash, and no leash
shall exceed 2.4 metres (8 feet)
(ii) when on the premises of the owner of the dog and not tied up or in a
properly enclosed area.
(f) For the purpose of this by-law, the Kitchener-Waterloo and North Waterloo
Humane Society shall be deemed to be the Poundkeeper of the City of
Waterloo and the Animal Shelter operated by such Society shall be deemed to
be the City Pound.
(g) In this by-law, the word "Animal Control Officer" includes the officers or
employees of the "Poundkeeper" as designated by it.

2.
(a) Every person residing temporarily or permanently within the limits of the City of
Waterloo, being the owner of a dog shall, before the 1
st
day of March in each year
cause such dog to be registered with the City Treasurer or their designate, and shall
procure a license therefor, which license shall expire on the 31
st
day of December in
each year in which the same was issued.
(b) Every owner of a dog shall cause a dog tag to be securely affixed on the dog at all
times (until the tag is renewed or replaced) bearing figures or marks indicating that
the license fee as hereinafter set out has been paid for the current year. Said tag
shall be supplied by the City Treasurer or their designate, upon the payment of the
license fee.
3.
(a) Every person residing temporarily or permanently within the limits of the City of
Waterloo, being the owner of a dog within the limits of the Corporation, shall, within Ten
(10) days after becoming the owner of such dog, cause the dog to be registered with the
City Treasurer or their designate and procure a license therefor, which license shall expire
on the 31st day of December in each year in which the same was issued.
(b) Every owner of a dog shall cause a dog tag to be securely affixed on the dog at all
times (until the tag is renewed or replaced) bearing figures or marks indicating that
the license fee as hereinafter set out has been paid for the current year. Said tag
shall be supplied by the City Treasurer or their designate, upon the payment of the
license fee.
4.
The dog tag shall bear the serial number and the year in which it was issued and a record
of their issue shall be kept by the City Treasurer. Such registration shall set out the name
and address of the owner, the name of the dog, breed and date of the dog's last anti-rabies
inoculation.
5.
No license or dog tag shall be transferable.
6.
Upon application for a license the owner may be required to produce a certificate signed
by a practising veterinarian that the dog has been inoculated with an anti-rabies vaccine
within a period of Twenty-Four (24) months prior to the date of application for a license.
LICENCE FEES
7.
At the time of registration, the owner, applicant shall be required to pay to the City
Treasurer, an annual license fee as set out in Schedule "A" attached hereto and forming
part of this by-law.
8.
The fee charged for the replacement of lost dog tags shall be $5.00.
KENNELS
9.
The owner of a kennel of dogs that are registered or eligible for registration with an
association incorporated under the Animal Pedigree Act (Canada) shall pay an annual
license fee to the City Treasurer, as set out in Schedule 'A' attached hereto and forming
part of this by-law. This fee is a license fee for a kennel.

RUNNING AT LARGE
10. (a) No owner of a dog shall allow or permit such dog to run at large in the City of
Waterloo.
(b) Subsection 10(a) does not apply to dogs running at large within the fenced area of
Bechtel Park designated by the City as an off-leash are in which dogs may run at large.
IMPOUNDING OF DOGS
11. A dog found running at large contrary to the provisions of this by-law may be seized and
impounded in the City Pound; a dog so impounded shall be held for a period of
Seventy-Two (72) hours and if not claimed and released to the owner thereof within such
period of Seventy-Two (72) hours may then be destroyed or sold by the Poundkeeper as he
or it may deem fit, and the selling price of any dog so sold shall belong to the
Poundkeeper. In addition to any other penalties contained in this by-law any dog so
impounded shall not be released until the owner thereof shall pay to the Poundkeeper the
sum of Thirty-Five ($35.00) Dollars for the first day or any part thereof and Ten ($10.00)
Dollars for each additional day or part thereof which the dog has been impounded.
12. The owner of every dog impounded if known, whether or not the dog is claimed by the
owner from the Pound, shall be liable for the payment of the Pound fee and shall pay all
fees on demand to the Poundkeeper.
13. Where any dog seized under the provisions of this by-law is injured or should be destroyed
without delay for humane reasons or for the reasons of safety to persons or animals, the
Poundkeeper may kill the dog in a humane manner as soon after seizure as he thinks fit
without permitting any person to reclaim the dog or without offering it for
sale.
14. The Poundkeeper shall keep a record of every dog impounded or seized, including a
description of the dog, the license and tag number if it wore a tag, and the date of
disposition and the disposition made.
15. Any dog impounded not wearing a tag for the current year may be given an inoculation to
provide immunization against rabies.
RABID DOGS
16. It shall and may be lawful for the Medical Officer of Health at any time whenever the
disdane of canine madness known as hydrophobia is prevalent, to issue a proclamation
directing all dogs to be confined, tied up or muzzled for a limited period of time to be
named in such proclamation and during such period of time it shall be a special duty of the
Poundkeeper and any persons authorized by the Poundkeeper to destroy all dogs not
confined, tied up or muzzled.

17. Any dog known to be rabid shall be immediately destroyed by the Poundkeeper or the
Animal Control Officer.
18. Where a dog is alleged to have bitten any person, such dog may be impounded on the
order of the Regional Medical Officer of Health in the manner prescribed by the
Regulations under the Health Protection and Promotion Act, 1983.
DOG WASTE
19. Every person who owns, harbours, possesses or is in control of any dog shall remove
forthwith and dispose of any excrement left by said dog on any property in the City of
Waterloo other than the premises of the owner of the dog.
MISCELLANEOUS MATTERS
20. Except in an Agricultural Zone pursuant to the Zoning By-Law of the City of Waterloo, no
owner or occupier of a premises may keep more than three (3) dogs. For the purpose of
this paragraph, puppies up to an including three months, weaned or not weaned, shall not
be counted in determining the number of dogs on a premises.
21. The City, its agents and servants, and the Poundkeeper shall not be liable for damages or
compensation for any dog killed under the provisions of this by-law and no such damages
or compensation shall be paid to any person.
22. Where a dog is alleged to have bitten any person or domestic animal, such dog may be
impounded and held by the Poundkeeper until proceedings under the Dog Owners'
Liability Act, R.S.O. 1980, Chapter 124 have been followed, provided that no dog shall be
so impounded or held for a period in excess of Twenty-One (21) days unless otherwise
ordered by the Judge.
PENALTY PROVISIONS
23. Any person convicted of a breach of any of the provisions of this by-law is guilty of an
offence and shall forfeit and pay a fine not exceeding the sum of Five Thousand
($5,000.00) Dollars for each such offence and every such penalty shall be recoverable
under the Provincial Offenses Act, R.S.O. 1980, Chapter 400, as amended.
REPEAL OF CERTAIN BY-LAWS
24. By-Law No. 87-102 for the City of Waterloo and any other By-Law inconsistent with
provisions of this by-law are hereby repealed.
25. This by-law shall come into effect five months from the date of its passage.
