by-law NO. 37 - 04
OF THE
CORPORATION OF THE CITY OF CAMBRIDGE
Being a by-law of the Corporation of the City of
Cambridge to regulate the storage of unused and
abandoned refrigerators and to repeal by-law 137-84.
WHEREAS the Municipal Act, 2001, S.O. 2001, c.25, S.130 provides that a municipality
may regulate matters not specifically provided for by this Act or any other Act for purposes related to
health, safety and well-being of the inhabitants of the municipality.
AND WHEREAS the Municipal Act 2001, S.O. 2001, c.25, s.128 provides that a local
municipality may prohibit and regulate with respect to public nuisances, including matters that in the
opinion of Council, are or could become or cause public nuisances;
AND WHEREAS the Council of the Corporation of the City of Cambridge deems it
necessary to prohibit and regulate the outside storage of refrigerators.
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE CITY OF
CAMBRIDGE ENACTS AS FOLLOWS:
DEFINITION
1. That in this by-law:
(a) "Refrigerator" means any refrigerator, ice box, box, chest, freezer or similar article
which has a door or lid capable of being closed or locked.
2. No person shall store or keep on his/her premises, or any premises leased or controlled by
him/her, any refrigerator which is not in use and operating unless the door of such refrigerator
has been removed.
OFFENCE
3. THAT any person who contravenes any provision of this by-law is upon conviction guilty of an
offence and is liable to any penalty as provided for by the Provincial Offences Act.
SHORT TITLE
4. This by-law may be cited as the Refrigerator by-law.
by-law REPEAL
5. THAT City of Cambridge by-law No. 137-84 be repealed.
