by-law NO. 32- 04
OF THE
CORPORATION OF THE CITY OF CAMBRIDGE
Being a by-law of the Corporation of the City of Cambridge to provide
for the prohibiting and regulating of noise within the municipality and
to repeal by-law 72-89.
WHEREAS the Municipal Act, 2001, S.O. 2001, c.25, S.129 provides that a municipality may pass by-
laws prohibiting and regulating noise within the municipality.
AND WHEREAS the Council of the Corporation of the City of Cambridge deems it necessary to
prohibit and regulate noise within the municipality.
NOW THEREFORE THE MUNICIPAL COUNCIL OF THE CORPORATION OF THE CITY OF
CAMBRIDGE ENACTS AS FOLLOWS:-
DEFINITIONS
1.
That in this by-law:
(a)
"Material Handling Equipment" means any equipment or device designed and intended for use
in material handling, including, but not limited to, air compressors, pile drivers, pneumatic or
hydraulic tools, bulldozers, tractors, excavators, trenchers, cranes, derricks, loaders, scrapers,
pavers, off-highway haulers or trucks, ditchers, compactors and rollers, concrete mixers,
graders or other material handling equipment;
(b)
"Emergency" means an event which occurs, which in the opinion of the Chief Administrative
Officer of the City of Cambridge or designate, requires immediate repair or replacement of
equipment, services, or facilities or to maintain a required public service or to prevent danger
to life, limb or property within the City of Cambridge.
2.
(a)
No person shall ring bells, blow horns, shout, make or permit unusual noises, or noises likely
to disturb the inhabitants of the municipality.
(b)
Sound or noise arising from the use of material handling equipment is prohibited between the
hours of 8:00 p.m. Saturday and 7:00 a.m. Monday, except in the case of emergency.
OFFENCE
3.
THAT any person who contravenes any provision of this by-law is, upon conviction, guilty of an
offence and is liable to any penalty as provided for by The Provincial Offence Act.
SHORT TITLE
4.
This by-law may be cited as the "Noise by-law".

5.
THAT City of Cambridge by-law No. 72-89 is hereby repealed.
READ A FIRST, SECOND AND THIRD TIME,
ENACTED AND PASSED, THIS 9TH DAY OF FEBRUARY, A.D., 2004.
